General terms of business

A. General

  1. The agency/author maintains full ownership of all photos delivered via Internet or CD. Pictures are placed only temporarily at the disposal of the customer. He/she is granted the right of use as defined by copyright.
  2. Without written permission by agrarfoto.com, photos must not be saved on electronic media longer than required for production. It is illegal to set up picture archives/databases with our photos. Moreover, pictures must not be added to existing databases without our approval.

B. Fees

  1. The publication of each of our photos is subject to fees.
  2. Charges relate to one-time use for a determined purpose and scope only. Further use is again subject to fees and requires our previous written approval.
  3. Our image fees are comparable with prices found in similar publishing businesses. Non-editorial fees depend on purpose, image size and circulation.
  4. We charge customers for all picture downloads in 300 dpi printing quality. However, customers are not required to pay for unused images, if we are duly informed by e-mail.

C. Disposition restrictions, liability, commercialisation and copyright

  1. All photo models have to be treated as originals. Generally, only the photographic copyright use can be transferred. In particular, this applies to photo models of which copyright is also determined by content.
  2. It is illegal to pass on photo material or reprint rights to third parties. Further more, reproductions, enlargements as well as the production of Internet negatives and duplicates are not permitted. Digital photo material may not be copied for archives of the customer, or for third parties.
  3. The user has to regard the journalistic principles of the press council (press codex). The user, respectively, the customer, is responsible for proper naming and identification..

D. Copyright / specimen copy

  1. All pictures are protected by copyright.
  2. We explicitly demand an agency and author citation note which must be clearly associated with the respective photo.
  3. A valid author citation is "photo: agrarfoto.com"
  4. Every single utilization is subject to the regulations of the Austrian copyright law.
  5. We request the customer to send us a specimen copy

E. Terms of payment/legal domicile

  1. Full payment is due upon receipt of invoices within 30 days.
  2. Legal domicile for all disputes is Linz/Danube, Austria.
  3. Austrian law supports all deliveries throughout the world.

F. Data protection security

agrarfoto.com guarantees to use the registration data exclusively for the handling of usual business affairs. agrarfoto.com will inform all customers irregularly via e-mail about any news and changes. This service can be cancelled at any time.

G. Miscellaneous

agrarfoto.com does not undertake any liabilities in connection with the use, application or download of our photos/digital picture data.
We do our best to continuously develop our photo database and Internet pages. Please be aware that on occasion, they may contain errors.
agrarfoto.com cannot guarantee that provided Internet pages are free of viruses, unauthorized program-, Java-, or source codes. Additionally, the existence of process disturbing components or parts may not be eliminated.
You herewith agree to assume all risks in connection with the use of agrarfoto.com pages. It is your own responsibility to take precautions in order to protect yourself against damages, threats or losses caused by the use of agrarfoto.com Internet pages.
Visitors to our Internet pages are required to pay for all costs associated with repairs, service, or corrections caused by the use of agrarfoto.com. Exemption from liability applies to all agrarfoto.com Internet pages.
